Re:  Account of [your name]; Account Number ______________

Dear [Name of Owner or Manager]:

The purpose of this letter is to inform you that one of your employees has violated the Fair Debt Collection Practices Act.  Specifically, your employee has contacted both my mother and employer on several occasions last week and revealed information about my delinquent debt to both of them.

The Fair Debt Collection Practices Act § 804 Acquisition of location information [15 USC 1692b] states:

"Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall -- (1) identify himself, state that he is confirming or correcting location information concerning the consumer, and, only if expressly requested, identify his employer;  (2) not state that such consumer owes any debt;  (3) not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information."

Do not telephone my mother or employer again!  If this behavior continues, I will report your firm to the FTC, to ConsumerFinance.gov, and my state's Attorney General's Office, and I will take all legal remedies available to me under the FDCPA for any damages that your firm's behavior cause me.

Sincerely,

Your name
